Terms of Service

These Terms of Service ("Terms") govern your access to and use of ProdVisual's website, API, and related services ("Service") operated by FollowTurk LLC ("Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

ProdVisual provides an AI-powered product image generation API for e-commerce platforms, digital marketplaces, and listing tools. The Service allows users to submit product images via API and receive AI-generated visual outputs. All functionality is delivered exclusively through our REST API.

2. Account & API Access

• You must provide accurate information when creating an account or purchasing credits.
• You are responsible for maintaining the security of your API key. Do not share your API key publicly.
• You are responsible for all API activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits & Payments

• API credits are purchased in advance and consumed per API call (1 credit = 1 generation).
• All prices are listed in US Dollars (USD).
• Payments are processed securely through Stripe. We do not store payment card information.
• Credits are non-transferable between accounts.
• Credits do not expire as long as your account remains active.
• We reserve the right to change pricing with 30 days advance notice.

4. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, fraudulent, or infringes on third-party rights
• Upload images containing illegal content, nudity, or violence
• Attempt to reverse-engineer, decompile, or extract the underlying AI models
• Circumvent rate limits or abuse the API infrastructure
• Resell API access without written permission
• Use automated systems to create accounts or bypass restrictions

5. Intellectual Property

• You retain ownership of all product images you upload to our Service.
• You receive a full commercial license to all AI-generated output images.
• We do not claim ownership of your input or output images.
• The ProdVisual brand, website, documentation, and API are our intellectual property.

6. Service Availability

We aim for 99.9% API uptime but do not guarantee uninterrupted access. We may perform maintenance with reasonable advance notice. We are not liable for downtime caused by third-party services, force majeure, or circumstances beyond our control.

7. Limitation of Liability

To the maximum extent permitted by law, ProdVisual and FollowTurk LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless ProdVisual and FollowTurk LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

9. Termination

Either party may terminate the relationship at any time. Upon termination, unused credits may be refunded at our discretion per our Refund Policy. We reserve the right to immediately terminate accounts engaged in abuse or violation of these Terms without refund.

10. Governing Law

These Terms shall be governed by the laws of the State of New York, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance.
